Man Charged With DUI While Visiting Dead Brother

The following arrests were reported by the Middletown Police Department. An arrest does not indicate a conviction.

A Newport man was charged with his third driving under the influence (DUI) offense, a felony, Wednesday as he attempted to visit his dead brother in the cemetery, according to police reports. 

Timothy Keith Marks, 38, of 15 Meeting St., was arrested at 2:45 a.m. after a vehicle, operated by Marks, pulled into the cemetery at Newport Memorial Park. 

A police officer first spotted the red Chevrolet S10, operated by Marks, traveling north on Vaucluse Avenue. A check of the vehicle's registration did not match the vehicle's description.

The police cruiser followed the vehicle into the cemetery, where the Chevrolet came to a stop and turned off all lights.

According to police, an aroma of alcohol was detected. The operator appeared to have glossy eyes and slurred speech.

The operator, Marks, told police he had "several alcoholic beverages" and drove to Newport Memorial Park to visit his brother who is buried in the cemetery, according to police reports. 

Marks apparently refused to perform a field sobriety test and, after being transported to Newport Hospital after complaining about internal pain, allegedly refused a chemical test. 

He was charged with DUI, third offense or greater, a felony; driving on a suspended license; and refusal to submit to a chemical test, second offense. 

Marks is also wanted by police in Pensacola, FL, on unknown charges.
