Police Log: Pants On The Ground

The following charges were reported by the Middletown Police between Friday April 27 and the morning of Monday, April 30.

Robert Upchurch, 67, of 140 Doyle Ave, Providence, was arrested Saturday around 1:39 a.m. on a charge of driving under the influence.

Police were dispatched after a witness reported that a heavily intoxicated man was leaving the Shell Gas station on East Main Road in a black Buick.

Police found the vehicle, and reported that before they pulled it over, it was swerving across the road, traveling between 5 and 10 mph. Police reported that they asked Upchurch two times if he had been drinking, and he stated that he had not.

Police said when they asked him a third time if he had been drinking, he responded, “Ya, I’ve been drinking all day.”

When Upchurch exited the vehicle, police reported his pants were at his knees and he had urinated on himself.

He registered a .264 on the breath test.

Driver in Friday’s Motorcycle Accident Charged with DUI

On Friday afternoon around 3:15 p.m., Joshua Kolator of 39 Allston Ave, was was charged with a Driving Under the Influence after he was involved in a motorcycle accident on Aquidneck Avenue that resulted in a minor head laceration.

“For the record, I only had two beers,” Kolator reportedly told police.  

When on the stretcher, police said his eyes were watery and bloodshot and that he failed the horizontal gaze test.

Kolator told police he was doing yard work all day and was going to BJs for supplies. Kolator was also cited for refusal to submit to a chemical test.

Passenger Allegedly Lied To Police That He Had Been Drinking and Driving

When were called to an accident on Saturday around 1:11 a.m., a 37-year-old Newport man told police he was the driver of the vehicle. Police reported that he was leaving Brewski's Pub and he said that Rafael Valdes, 37, of Newport, was the passenger. He allegedly told police both the men had been drinking.

Their car reportedly hit parked cars in a nearby auto dealership.

Police calledto respond to lacerations on the man's head and neck, and because parts of glass was still embedded in his skin. Police reported that when they inspected the car, the passenger side of the windshield was damaged but there was no damage to the glass on the driver's side.

When police asked the man again who had been driving, he allegedly admitted that he was the passenger and Valdes was the actual driver. A breath test of Valdes returned a .186 reading.

Valdes was charged with a DUI and Driving with a Suspended License.

Bench Warrant
Chad Mattos, 35, of 72 Russell Ave., Portsmouth, was arrested Saturdayabout  1 p.m. on an active bench warrant. Police reportedly saw passengers of a Dodge Caravan without seat belts and ran Matto’s registration. Police stopped the vehicle in the Middletown Square and arrested Mattos without incident.
