Middletown Police Make 3 Thanksgiving DUI Arrests

The following arrests were reported by the Middletown Police Department. An arrest does not indicate a conviction.

Middletown police made three DUI arrests on Nov. 28, 2013.

  • Philip Ventura, 21 249 Old Mill Lane, Portsmouth was arrested around 1:48 a.m. on a first offense driving under the influence charge. He was also cited with refusal to submit to a chemical test and nine traffic violations. Police said he was speeding and swerving down Purgatory Road, past Second Beach and eventually into Third Beach without stopping at some stop signs or without his headlights illuminated. When police caught up to Ventura, the officer asked if he was aware he put his passenger’s life and the public’s life in danger. He allegedly responded, “I know, I’m so [expletive] up.” He allegedly tried to drop names of Portsmouth and Middletown police and asked if they could “work it out with him" to get out of charges.  

  • Leroy Brian, 44, of 60 Fayal Lane, Middletown was arrested around 8:48 p.m. on a first offense driving under the influence charge. He was also cited with refusal to submit to a chemical test. He was allegedly swerving and speeding 23 mph over the posted limit on Turner Road.  Police said his 9-year-old son was in the back seat of the car. The officer reported a strong smell of alcohol and “thick-tongued’ speech. He allegedly said he had a couple glasses of wine at his cousin’s house that evening. He failed the field sobriety tests and was arrested. Police contacted DCYF.

  • Noble Fidalgo, 33, of 22 Honeyman Ave. Apt #B, Middletown was arrested at 9:47 p.m. on a first offense driving under the influence charge and possession of marijuana, both misdemeanors. He was also cited with refusal to submit to a chemical test and three traffic violations.  Police said he was pulled over for driving erratically and speeding.  Police said he appeared to be drunk and had three empty beer cans in the car.  He failed the field sobriety tests and was taken into custody.  Police found almost 3 ounces of marijuana in the trunk.
