Police Logs: 2 DUIs, Bench Warrants and a Domestic Assault in a Hotel

The following information is based on Middletown Police Department arrest reports and does not indicate any convictions.

The following arrests were made by the for the period between the evening of Thursday, Feb 23, and the morning of Monday, Feb 27.

DUI Arrests

Arnold Rivera, 35, of 83 Ruth St., New Bedford was arrested on Friday, Feb 24, on a first offense driving under the influence charge and cited for refusal to submit to a chemical test.  

According to the police report, a black Nissan Maxima was traveling north on West Main road, straddling the white dividing line.  The car drifted left and then crossed the yellow dividing lines. Police activated emergency lights to signal the car to pull over.

The car continued until the sirens were activated. The police report stated that the car then abruptly turned right, hopped the curb and came to a stop.  When the officer existed the cruiser, the car continued to roll forward.  The officer ordered the driver to stop the vehicle, when it allegedly lurched forward and its tires screeched.  

The officer reported a strong odor of alcohol from the car. Rivera allegedly told the officer he had a “couple of drinks” at the Blues Cafe in Newport,  but that he was okay to come home.  The officer reported that when he asked him questions, his responses were mumbled and unrelated to the questions he was asked.

When he asked Rivera to count backwards from 31 to 19, he began at 35, counted to 28, then he allegedly told the officer he suffered from dyslexia and could not count backwards.  The officer then had Rivera perform the fingertip touch test.

The officer reported he had Rivera exit the vehicle and performed a terry-pat for weapons.  During the pat, he felt a hard square in his coat pocket.   The officers found it to be a flask of tequila.  

After conducting the field sobriety tests, police brought him into custody without incident.  

Bruce Moravec of 98 Riverside Dr., East Providence was arrested Friday, Feb 24 at 11:40 p.m. on a first offense misdemeanor driving under the influence charge and cited for presence of alcohol in a motor vehicle.    The police report stated his Red Mini Cooper had a brake light out and was stopped on West Main Road in front of Monroe Muffler.  

When the officer asked if he had any alcoholic beverages, police reported Moravec said he had four or five beers since 8:00 p.m that evening.  The officer reported he saw an open Dale’s Pale Ale beer in the center console of the vehicle.  

When searched, police reported they found a small bag of marijuana in his pocket.  After questioned, Moravec told officers he had another small bag of marijuana in his car.  After given the field sobriety tests, Moravec was processed and brought the station where he blew a .125 and .116.

Bench Warrants and a Domestic Assault

Xavier Perry, 18, of 12 Callender Ave, Newport was arrested Monday, Feb. 27, at approximately 1:21 a.m. for a bench warrant issued from family court, obstruction of an officer and warrant of arrest on affidavit.  

According to the police report, the officer identified who he believed to be Perry in the back of a moving vehicle, stopped the car in the Bank Newport parking lot at the intersection of East Main Road and West Main Road. Perry who had an active warrant for juvenile escaping from the State Police and a family court bench warrant for failure to appear on Jan. 18., was in the back of the vehicle.

When the officer asked the driver who was sitting behind her, she replied “my friend Kyle." When the officer asked Perry to provide identification,  Perry responded he did not have an ID on him, said his name was “Kyle Perry” and gave him a fake birth-date and social security number.  

The officer pulled up a recent photograph of Perry in the police system, and positively identified his birth marks on his face.  The officer reported Perry continued to insist his name was Kyle, but finally admitted he was Xavier.  

Perry said he lied because “it was a bad time for him to go to jail.”

Thirty-year-old Robert Ezell of 10 Francis St., Bristol was arrested on Friday, Feb 24 at 12:15 p.m. for a bench warrant issued from superior court and a bench warrant issued from 2nd district court.  

According to the police report,  a registration check on the vehicle showed it was suspended for inspection.  The officer stopped the vehicle on Burma Road and a search showed the owner had two active warrants.  The front passenger identified himself as Ezell, and the owner of the car.

Ezell was taken to custody without incident.  

Twenty-four-year-old Corey-Joseph Walker, of 936 West Main Road was arrested on Thursday night at approximately 7:44 p.m. on simple assault and battery charges.

Police were called to the Newport Spa Hotel on West Main Road on a domestic assault. According to the police report,  when police arrived to the scene, Walker’s girlfriend told the officers they had been arguing in the room they share when he allegedly became phyiscal.

She allegedly grabbed a package of kitchen knives and ran out the door.  Police stated Walker denied a physical altercation but she had minor injuries indicative of a struggle and showed a text that she wrote that said “Drew is not letting me out of the door. I am getting scared.”

Police arrested Walker without incident.
