Speeding Ticket Results in DUI, Resisting Arrest Charges

The Middletown Police Department reported one arrest early Thursday morning.

Scott Pearson Garvey, 63, of 6 Cooke Road, Kuli, Hawaii, was arrested around 1:15 a.m. Thursday in Middletown on charges related to drunk driving and resisting arrest.

According to the report, a patrol officer stopped Garvey's car outside his local residence of 3 North Drive after observing him allegedly speeding at 46 mph in a posted 35 mph zone on East Main Road. Police at the scene allege they detected the smell of alcohol, glossy eyes and slurred speech during questioning before performing a field sobriety test.

Police described Garvey as being unsteady and unable to follow directions during the sobriety tests, before reportedly becoming argumentative and informing the police officers that he was a tax-paying citizen who paid their salaries.

Police also allege that Garvey refused to take a preliminary blood-alcohol concentration (BAC) breath test and that he resisted arrest during handcuffing, prompting police to cuff him on the ground, where he sustained minor abrasions to his cheek, according to the arrest record.

Later at the Middletown Police Station, Garvey allegedly continued to be disruptive and refused to take a BAC chemical test, refused to sign or look at his booking paperwork, and also declined medical treatment for the facial abrasions, the police report stated. At Garvey’s request, he was arraigned by a Justice of the Peace and released around 3:45 a.m. and transported back to his local residence.

The Middletown Police Department charges filed against Garvey include driving under the influence of alcohol, a first offense misdemeanor, resisting arrest, speeding in excess of 11 or more miles per hour, refusing to take a preliminary BAC breath test and refusing to take a chemical BAC test.
