A Fall River man was arrested Monday in Portsmouth after he allegedly drove under the influence with three children in the car. Police stopped an erratic vehicle driving on Route 24 South at Boyd's Lane around 8 p.m. An aroma of alcohol was detected in the vehicle, police said. The operator, James Diffley, 46, of Fall River, failed a field sobriety test. He later failed a Breathalyzer test at the police station. Diffley's Blood Alcohol Count was recorded at 0.2 on the first test and 0.197 on the second test. The legal limit in the state is 0.08. Diffley was arrested and charged with DUI, first offense, 0.15 BAC or greater. A subset of the charge, police said, deals with driving with a child under age 13 in the vehicle. Three children …

The Senate approved legislation to stiffen penalties for adults who drive under the influence with a child in their vehicle on Wednesday. This bill comes after several people were charged with driving under the influence in Middletown as well as across the state. In one example on Route 95 in October, state troopers arrested a 25-year-old Richmond man who was allegedly driving drunk at 120 miles an hour with his 2-, 3-, and 4-year-old children in the car. “Driving under the influence is a serious offense, but it rises to a new level of danger when it endangers a helpless child. People who drive drunk with a child in their cars are committing a much more serious crime than DUI, and they deserve a much more significant sentence,” said …

As lawmakers discuss strengthening DUI laws in Rhode Island, the consequences for being found guilty of drunk driving could become even more severe. Current Rhode Island DUI laws allow drivers under the age of 21 to have more alcohol in their system than drivers of legal drinking age.
A loophole in Rhode Island law allows drivers under the age of 21 to have a higher alcohol content than those of legal drinking age, something legislators are working on closing. For adults over the age of 21 the legal limit is .08, but for drivers under 21, the limit is .10 before the charge is criminal. A bill (H5432/S0560) will be discussed this week to close the gap, as part of a number of legislative initiatives aimed at strengthening the state’s DUI laws and improve highway safety, authored by Attorney General Peter Kilmartin. “It just makes sense that it is .08, for consistency sake, regardless of the age of the person,” said Sen. Police arrested Erin Hebel, 51, of 280 Compton View Dr., on charges of driving under the influence. She was also cited with refusal to submit to a chemical test. On Friday around 5:47 p.m., Middletown Police were dispatched to Aquidneck Avenue for a check condition on a tan SUV. Police said the suspect car was traveling approximately 15 mph in a 25 mph zone. The car swerved across the road, turned on Morrison Avenue but ran over the curb, clipped the corner of a snow bank and continued to drive over the grass and the road, said police. Kevin Dickson, of 18 Pennsylvania Ave., Warren, was arrested on Saturday Feb 16 around 1:34 a.m. on charges of driving under the influence with a BAC of .10-.15. Middletown police said they pulled Dickson over on West Main Road for driving 50 mph in a 35 mph zone. Police said he showed signs of intoxication such as bloodshot eyes, slurred speech and smelled of alcohol. Dickson allegedly told police he had a few beers in Newport. He failed the field sobriety tests and was taken into the Middletown Police Department. At the station, he registered a blood alcohol content of .135 and .137 between 2:19 a.m. and 2:21 a.m., said police. He was also cited for speeding and a violation for swerving across the travel lanes.

Karen Tungett, 35, of 22 Continental Dr. Apt. 1, was arrested on Sunday on a misdemeanor charge of domestic disorderly conduct. She allegedly got into a fight with a 31-year-old Middletown man about breast feeding their 8-month-old son. He told police he did not want her to feed the baby because she had been drinking. He alleged she physically assaulted him to the point that he had to pin her to the wall to stop her from harming him further. Tracy Butler, 54, of 28 Brownell St., Warren was arrested on Saturday around 10:52 p.m. on a first offense driving under the influence charge.
